CraftWare EULA

End User License Agreement

Please read the terms of this End User License Agreement carefully.

This End User License Agreement (hereinafter: EULA) regulates the use of the software Craftware Pro (hereinafter: Software). This EULA is between the individual consumer or business entity that will use the Software (hereinafter: User) and CraftUnique Korlátolt Felelősségű Társaság (hereinafter: CraftUnique).

By accepting the terms of this EULA User agrees to be bound by the following terms.

1. Use of the Software

1.1 User can download the Software from CraftUnique’s website: https://craftbot.com/software

1.2 After the download, User installs the Software on its own computer.

1.3 User can download the Software for free, although certain functions can be achieved solely by purchasing a premium license.

1.4 User hereby notes premium functions inside the Software are solely provided within a premium license which can be purchased at CraftUnique’s webshop: https://shop.craftbot.com/ and shall be activated through a logged in user profile (hereinafter: Premium Functions).

1.5 Craftunique provides two types of premium license, Premium Personal Licence and Premium Enterprise Licence.

1.6 Premium Personal Licence may only be used solely by natural persons, non-profit organizations, and such small and medium-sized enterprises whose net annual revenue regarding the preceding business year do not exceed USD 100.000.

1.7 Premium Enterprise Licence may only be used by such legal entities whose net annual revenue regarding the preceding business year exceeds USD 100.000.

1.8 In case User don’t have a registrated user profile, in order to use Premium Functions, User shall create an user profile on the website https://craftbot.com/, by clicking on "Creating an account”.

1.10 No purchases inside the Software. 

2. Rights and obligations related to the use of Software

2.1 The Software is licensed and not sold. By downloading the Software, User is granted for a non-exclusive use of the Software for the duration of the EULA.

2.2 Software shall be used solely for purposes stated in this EULA.

2.3 Basic functions of the Software may be used by any natural person or legal entity for personal, industrial, economic and for other purposes in accordance with this Agreement.

2.4 The rights granted to the User of the Premium Functions are subject to the following restrictions:

  1. a) Premium Personal License
  • Natural persons shall use the Software solely for personal purposes
  • Nonprofit organizations shall use the Software solely for marketing and business purposes
  • Small and medium enterprises shall use the Software solely for industrial, marketing and business purposes
  1. b) Premium Enterprise License
  • Users of the Premium Enterprise License shall use the Software for industrial, marketing and business purposes

2.5 User may use the Software solely on its own computer.

2.6 User may make a reasonable number of copies of the Software needed for backup purposes.

2.7 The rights granted to User in this Agreement are subject to the following restrictions:

  • User shall not modify, make derivative works of, disassemble, reverse compile or reverse engineer any part of the Software or the idea, structure, algorythm the Software is based on;
  • User shall not access the Software in order to build a similar or competitive product or service;
  • User shall not use the Software to violate law or any third-party right.
  • User acknowledges by using the Software, User shall not acquire any rights to use graphics elements that are part of the Software.

3. Data Process

3.1 The Software collects data related to its use. When an online connection is established on User's computer, the Software automatically transmits the collected data to CraftUnique's central server.

3.2 If the User uses the Software without logging in to a registered user account, the data collected, as User cannot be identified relying on it, shall not be considered as personal data.

3.3 In the event User uses the Software while logged in to a registered user account, the data collected by Software is considered as personal data. In this case, rights and obligations regarding the data process are stated in the Data Protection Statement, which can be found on CraftUnique’s website: https://craftbot.com/privacy

4. Limited Warranty

4.1 User shall use the Software as intended, in accordance with the User Guide. User will be liable for any damages or expenses arising from not complying with this obligation.

4.2 User agrees that CraftUnique shall not be liable for any errors in the Software in the following cases:

  • the User's own computer does not work, does not work properly or is damaged by the User;
  • the error is caused by virus, malware or any other software installed by the User;
  • A third party entered into the User's own computer and caused damage to the Software or with the Software;
  • User does not use the Software as intended nor in accordance with the User Guide.

4.3 CraftUnique makes no warranty, including but not limited to any implied warranties of merchantability or fitness for a particular purpose, regarding the Software or accompanying materials. The Software and accompanying materials are provided solely on an as-is basis.

4.4 In no event shall CraftUnique be liable for any special, collateral, incidental, or consequential damages in connection with or arising out of the use of the Software and accompanying materials.

4.5 User is responsible providing the minimum software and hardware requirements for the proper use of the Software. CraftUnique shall not be liable for any malfunction resulting from User’s failure to comply with the minimum requirements.

5. Updates and services related to Software

5.1 Any future release, update, or other addition to functionality of the Software shall be subject to the terms of this EULA, unless CraftUnique expressly states otherwise. Neither CraftUnique nor any of its suppliers is obligated to provide any services, updates or upgrades to the Software.

6. Termination of EULA

6.1 This EULA is in force for the duration of the use of Software.

6.2 This EULA is terminated in the following cases:

  • User removes the installed Software from the computer,
  • CraftUnique is entitled to terminate the contract by an extraordinary notice.

6.3 In case User violates the terms set out in this EULA, CraftUnique is entitled to terminate the contract by an extraordinary notice and CraftUnique is entitled to claim damages for breach of contract against the User. In such a case, User must immediately delete or destroy Software, any part of Software or copies of the Software.

7. Exclusiveness of EULA

7.1 This EULA regulates the agreement between User and CraftUnique regarding the use of Software and other services related to the Software and repeals any other written or oral agreement, offer or statement regarding the Software or other services related to the Software.

8. Applicable law

8.1 This EULA and further questions not regulated in this EULA shall be governed by the hungarian law.

9. Other provisions

9.1 CraftUnique reserves the right to amend the provisions of this Agreement by an unilateral declaration. CraftUnique notifies User about the change through the Software when the Software is connected to the Internet. Prior to the first use of the Software and after the notification of the amendment to the Agreement, User is obliged to read and accept the provisions of the amended Agreement. The User is only entitled to use the Software in accordance with the provisions of the Agreement in force, so if CraftUnique amends the Agreement pursuant to this clause, User is entitled to continue to use the Software solely in accordance with the amended terms. If the changes are not accepted by the User, User’s right to use the Software will terminate.
